Provision of data

Apart from what is specified below for navigation data, the user is free to provide personal data contained in any information request forms or registration forms. Failure to provide them may make it impossible to obtain the information requested.
The data marked as mandatory in the forms on the Site are essential to process the request or to provide the service or performance requested to BEMA SNC.
The conferment of data and the relative consent to the treatment is optional with regard to the sending of the newsletter. The consent given may be revoked at any time without prejudice to the lawfulness of the processing carried out previously.

Categories of recipients

As part of the pursuit of the purposes listed above, the data provided may be known by the Data Controller’s collaborators specifically authorized to process them as persons in charge. These subjects are bound to secrecy and confidentiality also on the basis of specific Internal Regulations. The data strictly necessary for accounting and financial operations may be communicated to a trusted external professional on the basis of a legitimate interest. Where strictly necessary, the data may be communicated to couriers or forwarding agents (for the dispatch of goods), banks (for payments), insurance companies (for the management of any insured risks) and in general to all those subjects to whom the communication of the data is indispensable for the achievement of the above mentioned purposes.

Methods of processing

The data will be processed with the help of manual and electronic instruments, also in automated way. The data are not subject to any automated decision-making process, including profiling.
The processing, moreover, concerns data related to the performance of economic activities, treated in compliance with current legislation on business and industrial secrecy.
Should the processing also concern personal data falling within the category of particular data (Art. 9 GDPR – cd. “sensitive data”, i.e. data revealing racial and ethnic origin, religious, philosophical or other beliefs, political opinions, membership of political parties, trade unions, associations or organizations of a religious, philosophical, political or trade union, as well as personal data disclosing the state of health, life and sexual orientation) the processing will be carried out within the limits indicated by the General Authorisations of the Guarantor and by the subsequent equivalent legal provisions, according to the modalities provided for by EU Regulation 2016/679 and for the purposes strictly necessary for the regular performance of the activity, of the operations related to the supply of products/services and the fulfilment of contractual and/or legal/regulatory obligations.
Users are invited to avoid the insertion of particular or judicial data (art. 9-10 GDPR) superfluous, as this could lead to the destruction of the message and the failure to fulfill the request.
The processing operations connected to the web service of this Site are carried out by the owner through internal collaborators and through the external consulting company appointed as data processor.

Data retention period

The data are processed and stored for the time required by the purposes for which they were collected. Therefore:

  • Personal data collected for purposes related to the execution of a contract or a pre-contractual request between the Owner and the User/Customer will be kept until the complete execution of such contract and even afterwards for legal obligation (e.g. 10 years for invoices) or to protect or enforce or defend a right of the Owner.
  • When the processing is based on the User’s consent, the Owner may retain the personal data for a longer period of time, until such consent is revoked. In addition, the Data Controller may be obliged to retain Personal Data for a longer period in compliance with a legal obligation or by order of an Authority.
  • The data processed for legal obligation are processed for the entire duration provided for by the law applicable to each individual treatment.
  • The data processed on the basis of a legitimate interest are subject to processing until the interested party expresses his opposition (e.g. sending commercial communications to its customers – Art. 130 Paragraph 4 of Legislative Decree 196/2003).
  • At the end of the retention period personal data will be deleted. Therefore, at the end of this period the right of access, cancellation, rectification and the right to portability of the data can no longer be exercised.

Rights of interested parties

The data subjects (the natural persons to whom the personal data refer) have the right at any time to obtain from the Data Controller confirmation as to whether or not data relating to them is being processed, to know the source of the data, to request access to the personal data, to verify its accuracy or request its rectification, limitation, portability, to oppose its processing, not to be subject to an automated decision-making process (Art. 15-22 EU Regulation 679/2016). It is the right of the data subject to lodge a complaint with a European Supervisory Authority (in Italy it is the Guarantor for the protection of personal data based in Rome) or to lodge a judicial appeal (Art. 12 Paragraph 4 GDPR).
Requests should be addressed to the address of the company headquarters, also by writing to info@bemasnc.com. It is necessary that the data subject provides useful information to ascertain your identity, otherwise the Data Controller may not be able to satisfy the request of the data subject (Art. 12 Paragraph 2 GDPR).

Data processing place

The processing operations connected to the web service (“contacts”) of this Site take place at the above mentioned premises and are handled by the owner and by the consulting company appointed as responsible for the processing.
In order to send commercial and promotional communications to those who are already Customers (on the basis of a legitimate interest) or to those who have expressly consented (to send newsletters or communications for marketing purposes), the Owner uses the service offered by MailChimp (based in Atlanta, Georgia, United States). The collected data is stored on MailChimp’s secure servers. In accordance with MailChimp’s Privacy Policy, your data will never be used by MailChimp for purposes other than sending communications (e.g. it will not be sold to third parties, nor will Mailchimp directly contact the recipients of the Holder’s communications). MailChimp uses appropriately authorized operators to maintain the service and in the performance of these tasks they may have access to your data. Anyway, the guarantees provided by MailChimp privacy policy are valid. When the owner will send the emails, the data will be retrieved through the tools provided by MailChimp and thanks to them will be sent to the users.
The Owner has decided to use this service on the basis that MailChimp adheres to the Privacy Shield. Between Europe and the United States there is an agreement called “Privacy Shield” which represents a self-certification mechanism to which American companies can voluntarily adhere guaranteeing security measures adequate to European privacy standards..
In particular, the user may at any time and free of charge change his or her preference and ask to stop receiving commercial and promotional communications, using the forms on the Site and in the individual messages sent or by contacting the data controller directly. Following this request, the user’s data will be deleted.

Types of data processed

Automatically collected information

The computer systems and software procedures used to operate this Website acquire, during their normal operation, some personal data whose transmission is implicit in the use of Internet communication protocols.

This information is collected for the purpose of carrying out statistical surveys (anonymous) to determine which data/contents are more or less useful/interesting for the users and therefore to improve the effectiveness of the material available on the Site.

Data provided voluntarily by the User

The optional, explicit and voluntary sending of e-mail messages to the addresses indicated on this Site involves the subsequent acquisition of the sender’s address, necessary to respond to requests, as well as any other personal data included in the message.
